Meeting with PMG CCR : 20-9-2011

Today we met the  PMG CCR  and discussed the following  burning issues of CCR .

1. Extension of speed Post Counters at late night in various offices in CCR leading to 10.00 AM to    10.00 PM duty for the counter PAs,  Gr. D, APMs, Treasury and Mail Branches.
2  Extension of  business hours  of  MPCM  upto 06.00 PM  in various offices in CCR.

PMG CCR discussed with us  in depth  and  totally seized of the issue.  He informed
that  the intention of the  administration is to  extend  counter facilities  to the  public especially in city area. However   he categorically assured that  no official will be  brought into duty beyond the prescribed eight hours.  He further instructed his subordinate over phone  that  all SSPOs., should be  suitably instructed  accordingly  with  specific instruction of   operating  separate spells of  counters ie. 

a) 10.00 AM to  06.00 PM. and
b) 01.00 PM to 09.00 PM.

We have further raised the apprehensions  of the officials doing  back office work  like Treasury,Mails and  Supervisor,  he has assured  to mitigate  the problem too; further informed that  it is only on trial basis  and will be reviewed after  3 months.  Even after this  if  there be  any ground level problem , so arises,   that  would also be addressed  positively.

Sir / Madam,

The undersigned is directed to say that procedure of checking of vouchers of deposits / new accounts opened / withdrawals /closures of accounts etc. under various schemes have been laid down in the Postal Manual of Savings Bank Control, Pairing and Internal Check Organization. The work of SBCO is to ensure that all relevant Rules / procedure and orders issued from time to time are followed by the operative staff in the post offices.

2. It has been brought to the notice of this office that some of the officials working in the SBCO are of the view that Rule and Procedures laid down in various POSB Manuals are not meant for SBCO. It is clarified that though it is duty of the operative staff in post offices to follow the laid down rules and procedures in various POSB Manuals and SB Orders issued from time to time, SBCO staff is also equally responsible to ensure that operative staff is following the rules/procedure and orders issued from time to time scrupulously and in case of any violation found during voucher checking, an objection has to be raised as per laid down procedure in the Manual of SB Control, Pairing and Internal Check Organization.

3. It is requested that necessary action may be taken immediately to circulate this clarification to the field units particularly SBCO staff.

4. This issues with the approval of DDG(FS).

ARBITRARY ACTION TO RECOVER MONEY IN THE NAME OF CONTRIBUTORY NEGLIGENCE

Respected Madam,

Memorandum submitted to the CPMG, TN Circle on  arbitrary recovery of money from the staff in the name of  contributory negligence, before taking any action on recovery of fraud amount from the  guilty.

It is a known fact to all that  one SAS agent Smt. Devasena, attached with Anna Road HPO  , has obtained the  signatures of the depositors, either in the closure applications or withdrawal forms , has committed frauds to the  tune of Rs.18,00,000.00.The case was reported to the  Police authorities and she has accepted the guilty and  confessed that she has defrauded the amount of her own. The modus operandi, as stated by her, that  she obtained the signatures of the depositors and acted as a messenger in most of the withdrawals. The administration has not taken any efforts so far to confiscate the property or her belongings in order to recover the defrauded the amount from her.

Whereas, the present Chief Postmaster, Anna Road HPO is attempting to fix responsibilities on almost all Pas working in SB Branch of Anna Road HPO, on one pretext  or the other in order to recover the amount in contributory factors , by citing minor lapses or the mistakes left unnoticed, which come under the extenuating factors.

There was no violation of  the statutory rules on this subject and there was no  difference in the signatures available in the  records and the agent was acted as a messenger in most of the cases which was permitted as per SB Rules. However all the PAs and supervisors  have been  tortured  frequently.

This action of the administration is nothing but  to protect the interest of the culprit.  Instead of pursuing the case vigorously  with the Police authorities for early prosecution of the guilty  and with the Revenue authorities  to recover the loss sustained to the Department,  the Chief Postmaster, Anna Road is causing arbitrary and unwarranted actions against  innocents.

It is to mention that the  present action initiated  to recover the loss sustained to the Department from the innocents  is against  to the provisions of Rule 106, 107 and 108 of Volume III and Rule 204 A(1) of Volume III, which stipulates that honest errors shall be  condoned.  This has further been discussed elaborately in FHB Volume I Appendix 4.         

                        

 The Directorate vide  their memo. no. 6/8/59-Disc. Dt. 9.7.59, while  discussing about the recovery under contributory  negligence stated that ‘it is of equal importance that the concept of contributory negligence should be  correctly understood by the Disc. Authorities and there should not be any attempt to somehow or  other  effect recovery of the entire  loss  sustained  by the  Department  by imposing punishments on official who are  guilty of only minor omissions’.

Though the said SAS agent is having  property worth to  Lakhs and Lakhs of  rupees,  no action is taken by the administration  to recover the loss sustained  to the Department from  the said agent,  by moving state  authorities or by confiscating the properties and belongings.   Instead  it is now resorting to cause action to recover the entire  the amount from the innocent officials under one pretext or the other. They know the only way to harass their own staff. This causes  serious concern.

Hence , the  entire staff of Anna Road HPO ,  now  ventilating their grievances by utilizing the form of age old trade union method of demonstration during the lunch hour  on 08.09.2011 against this. Hence the Circle Union requests the Chief PMG , TN Circle   kindly to intervene in this matter and  issue instructions to stop such harassment on the staff by way of  imposing  huge amounts of recovery on them, for the   frauds committed  by  the SAS agent  , besides  instructing  to take suitable  action with the  appropriate authorities so as to confiscate the properties and belongings of the SAS agent,  to recover the loss .

Sir / Madam,

The undersigned is directed to say that there are lot of audit paras raised by teams of DG P&T Audit in many circles regarding irregular commission paid to SAS agents where the investment was made exceeding the limit of Rs.50,000/- by cash at a time. One Draft Audit Para relating to Delhi and NE Circles has become CAG Para.

2. As per agency rules, prior to issue of SB Order No.3/2011 dated 11.3.2011, limit for acceptance of cash at a time from SAS agents was Rs.50,000/- which has now been reduced to Rs.10,000/-. In 2004, Regional Director, National Savings Institute, New Delhi vide letter no. Misc/2004 dated 3.11.2001 had intimated the Delhi Circle that agents are not entitled for commission on cash deposits of more than Rs., 50,000/- at a time. CAG Para was also referred to Min. of Finance (DEA) which opined that commission if paid in such cases is irregular and recovery of commission paid cannot be waived.

3.     It is therefore requested that where any SAS agent deposited cash more than Rs.50,000/- at a time in any post office and commission was paid to him, the commission paid has to be recovered from the concerned agent if his agency is active and action should be taken against the officials responsible for accepting cash deposits exceeding the prescribed limit. Where the agent is inactive but his agency is not lapsed, his appointing authority may be asked to recover the amount from his security deposit.

In case the agency of agent is expired and not further renewed or agent has already expired, such cases may be referred to this office.

4. In future, it may be ensured that no cash more than the prescribed limit of Rs.10,000/- at a time should be accepted from the SAS agents as no commission is payable on such irregular deposits.

5. It is requested that necessary action may be taken immediately to circulate this letter to field units and any violation of these orders by postal staff should be viewed seriously.

6. This issues with the approval of DDG(FS).

For your information: Criminal complaint can't hold up pension benefits

Hi All

Mere registration of an FIR or filing of a charge sheet under the Prevention of Corruption Act is not enough to withhold the release of pension benefits due to a government servant. The Central Administrative Tribunal (CAT) has ruled that final pension, gratuity, leave encashment or other such benefits due to a government servant on retirement cannot be held back in the event of a criminal complaint against him/her.The ruling came from a bench of CAT chairman VK Bali and member Ramesh Chandra Panda, which ordered the ministry of finance and the Central Board of Direct Taxes to restore forthwith the full pension of VB Bansal, Assistant Commissioner of Income Tax, and make payment of all arrears due within six weeks.

Invoking rule 69 of the Central Civil Service (Pension) Rules 1972, the government had withheld Bansal's final pension, gratuity, leave encashment and some other post-retirement benefits on the ground that a case of disproportionate assets registered against him by the Central Bureau of Investigation on February 2005 was still pending.Bansal had contended that after investigation, the CBI sent a report to the court for cancellation of the FIR in 2007, and he could not be made to suffer if the court had not taken any decision even after four years. The government argued that if no decision had been taken by the Magistrate concerned, on the cancellation report sent by CBI, it shall be deemed that judicial proceedings were pending.

But the CAT rejected the government's arguments, saying: "It is only after the Magistrate may not accept the cancellation report and may order further investigation in the matter, and on such investigation, the Central Bureau of Investigation (CBI) collects sufficient evidence, which may sustain conviction and the Magistrate may take cognisance, that judicial proceedings can be said to be pending against the applicant (Bansal)."While ordering payment of full pension and post-retirement benefits to Bansal, the bench did not agree to payment of interest on the amount due."However, if the arrears as mentioned above and the withheld post-retiral dues are not released to the applicant within the time mentioned above, the applicant will be entitled to interest thereon at the rate of 9% per annum from that date till the date of actual payment," it added.

Regarding PFRDA Bill

NPS -A parliamentary standing committee has favoured offering minimum guaranteed returns to subscribers

A parliamentary standing committee has favoured offering minimum guaranteed returns to subscribers of the New Pension System (NPS) and recommended a 26% foreign direct investment (FDI) cap in the pension sector through a legislative process.

The parliamentary standing committee on finance which submitted its report on the Pension Fund Regulatory and Development Authority (PFRDA) Bill on Tuesday, said that "as any effective pension scheme needs to be underpinned by stability of returns and reasonable post retirement incomes, it is imperative that the government should provide for minimum guaranteed return and not the mere camouflage of market-based guarantee."

The committee, headed by former finance minister and Bharatiya Janata Party (BJP) leader Yashwant Sinha, recommended that the minimum rate of return on the contributions to the pension fund of the employee should not be less than the rate of interest on the Employees Provident Fund scheme.

In the absence of such a guarantee, the NPS cannot justifiably claim to provide old age income security," it said.

The government had introduced the Bill in the Lok Sabha in March.

The PFRDA is yet to get statutory powers and the interim PFRDA is functioning since 2003 through an executive order.

The NPS was made mandatory for all new recruits to the government except armed forces with effect from January 1, 2004. It was opened to all citizens of India from May 1, 2009 on a voluntary basis.

As many as 27 states governments have notified and joined the NPS for their employees. As of now, its subscriber base has crossed 1.1 million with a corpus approaching Rs7,000 crore. The government is of the view that FDI in the pension sector should be capped at 26%, but the standing committee said the ceiling should be specified in the legislation itself and not through an executive order.

            Kindly see the minutes of the meeting of Steering Committee on PFRDA Bill held on 29^th Augst 2011, posted in the website.

            The Secretariat appeals to every state Committee to take initiative for the successful implementation of the decisions of the steering committee meeting on 29^th August 2011 i.e.

1.       Formation of joint committee in every station with the units of the participating organisations in the Steering Committee viz. AISGEF, Confederation of Central Govt employees and Workers, AIRF, STFI, AIDEF, NFIR, BSNLEU, AIFUCTO, BCPC & NCCPA.

2.       Prepare and mobilise for the Raj Bhawan march on 6^th Sept 2011 – under the banner of the joint committee

3.       Conducting Conventions where ever not held. The date of the Convention may be intimated to Confederation HQr so that one Secretariat member could be deputed to attend the convention.

4.       Start signature campaign – by involving all the membership and through them the people at large.

Every member may be asked to collect signatures from his/her family members and from the people at large in their locality.

The signature campaign in public places like railway stations, hospitals etc may be done under the banner of joint committee of the station.

5.       Prepare and mobilise for the March to Parliament on 29^th November 2011. The quota for each affiliate is given elsewhere in this circular. The Confederation State Committees has to ensure that the quota given to them be met.

6.       Educate the membership on the perils of the PFRDA Bill and prepare them for a two-hour demonstration on the day the bill is taken up for consideration by the Parliament.

            Every State Committee may send a detailed report on the steps taken by them on the above decisions.

MARCH TO PARLIAMENT ON 29^TH NOVEMEBR 2011 

            Each of the affiliate of Confederation may mobilise as per the quota given below.

             NFPE – 7500, ITEF- 1000, Audit-1000, NFAEEA-500, Civil Accounts-250, Ground Water Board-150, Central Secretariat-100, All other affiliates- 50 each.

            The State Committees of Confederation may take necessary steps to co-ordinate at the field level so as to ensure that each affiliate do send personnel as per the quota.

            Delhi and nearly by states of Delhi viz Rajasthan, MP, UP, Haryana and Punjab (Chandigarh included) will be given the quotas separately.

Subject: Revision of Stitching Charges.

            The undersigned is directed to say that based on a demand raised by the Staff Side, in National Council (JCM), the question of revising the Stitching Charges of Uniforms, supplied to Common Categories of employees (Multi-Tasking Staff - erstwhile Group 'D' posts of Peon, Daftry, Jamadar, Junior Gestetner Operator, Frash, Chowkidar, Safaiwala, Mali etc. and Staff Car Drivers, Dispatch Riders etc.) in the Central Secretariat and its Attached and Subordinate Offices, has been examined in consultation with the Ministry of Finance. Consequently, it has been decided to enhance the rates of stitching charges, with effect from 1^st April, 2011 thereby modifying the earlier instructions issued vide this Ministry's O.M. No. 14/3/2006-JCA dated 28" September, 2006.

2. The revised rates of stitching charges, with effect from lst  April, 2011, will be as under:-

            Winter

            (1) Buttoned-up-coat and pant               -Rs. 750

            (2) Over Coat for Staff Car Drivers    - Rs. 600

            (3) Ladies half-coat                                 -Rs. 600

            Summer

            (4) Pant (Terricot)                                   - Rs. 135

3. It may please be noted that the reimbursement of Stitching Charges at the-prescribed rates should be done only after the stitched uniforms are produced and are duly stamped, with indelible ink, at an appropriate place on the wrong side of the stitched dress, for identification. A proper record and procedure should be evolved to ensure that the employees produce the stitched uniforms within a reasonable period (say one month) after the cloth is supplied to them.

4. This issues with the concurrence of Department of Expenditure vide ID No. 5(1)/E.I1 (A)/2009 dated 08.04.201 1.

Postal service is needed for Corporation

The Chennai Corporation is planning to use the services of the Department of Posts to verify addresses of over 6.41 lakh property tax assessees.This is part of the measures of the civic body to improve property tax collection.It has started discussions for making optimum use of the services of the Department of Posts in the days ahead when the challenges pertaining to collection of property tax are likely to mount.

With elections round the corner, the Corporation would have to use tax collectors for election duty. So, the services of the postal employees are likely to be used to create awareness and improve tax collection, said officials of the Corporation.Address verification by the postal staff would also help the civic body verify the genuineness of the assessees during the city expansion phase.

A few months ago, the Corporation had initiated a process of sending e-post to remind the assessees. Though the property tax collection improved because of the initiative, some of the addresses of assessees were not correct.The civic body has also planned to ask the assessees to make use of the counters in the zonal and division offices for payment of tax during the period of civic body elections.

After the expansion of the city and local body elections, the Revenue Department would face a challenge in the form of change in zone number of the existing assessees.The Postal Department's schemes such as e-post would be continued to be used to remind the assessees of the property tax payment even after the elections.Over 10 per cent of the property tax assessees pay taxes of high value, official said. Even though the civic body focuses more on this segment, the assessees who pay very low value property tax would also be given awareness messages through the postal system.

A major portion of the 5.29 lakh residential property tax assessees in the 10 zones of the city have a property tax demand of low value. Address verification of such assessees may be easier with the help of the extensive network of post offices, according to an official of the civic body.Collection of property tax from over 1.12 lakh commercial properties in the city is likely to be better with the assistance of the postal network

India Post to provide visa services in remote areas!!!

Post office is going to provide visa services in remote areas!!!!!!!!!!!

The MOU sets out broad understandings and intentions of both the parties to provide visa related services at places where they are not currently available.

India Post has signed a Memorandum of Understanding (MOU) with M/s VFS Global to provide visa related services for different countries through Post Offices. Memorandum of Understanding between India Post and M/s VFS Global was signed here on 30.08.2011 in the presence of Secretary, Department of Posts and senior officers from Department of Posts and VFS Global. The MOU sets out broad understandings and intentions of both the parties to provide visa related services at places where they are not currently available. 

Post Office counters will be used for fee collections, providing visa applications forms, dissemination of visa information, biometric enrollment and other visa application process related services. India Post and VFS are also planning to cooperate in utilizing India Post’s courier service, Speed Post for movements of passports to VFS offices and concerned embassies, and their delivery back to the applicants. Both the parties will also explore to provide any other service that India Post may want to provide through VFS global network on mutually accepted terms. 

M/s VFS Global is in the business of visa application services and is working with 35 governments across the world with over 450 offices in 50 countries. India Post and VFS realize that there are many areas of mutual interest and synergy between India Post and VFS would benefit the public at large. 

Currently visa related services are largely available in metros only and the people from smaller cities and rural areas have to travel long distances in order to avail these services. Lack of information is also a major area of concern as this allows unscrupulous elements to cheat unsuspecting and vulnerable people. Engagement of India Post towards provision of visa related services is expected to address this situation to a large extent.

Assumed Charge after 3.5 yrs long legal Battle.. Satyameva jeyate!!!

After a long legal battle - not one or two – about 47 court cases right from Munsiff court to Supreme Court, the elected office bearers of Tamilnadu circle union assumed charges today as per the orders of the Chief Postmaster General, Tamilnadu circle. Many kudos and heartiest congratulations to Com J.Srivenkatesh, Com. J.Ramamoorthy, and Com A. Veeramani who were elected as Circle President, Circle Secretary and Circle Financial Secretary respectively in the conference held on 9.3.2011 & 10.3.2011 at Kavarapettai. The Circle Conference was conducted by the CHQ itself as per the decisions of the All India Conference, Pune. The 3 ½ year stalemate prevailed in Tamilnadu circle came to an end and we wish the office bearers for their success and trust that they will regain the past glory of the circle within a shortest span of time by their dedicated hard work.

Congratulations once again!!!!!!!!!!!!!

Independence day function at Chennai GPO

Good morning.

Today our honorable Chief Post Master Mr.R.Pandi had presided over for celebrating the 65th year of  Independence day function and unfurled the Indian National Flag at 9 am in our office premises.Our CPM gave the valuable speech related to Independence day and thereafter sweets were distributed to officials and public who gathered at the function.
